OSPREY PERFORMANCE LTD makes no representations or warranty about products protecting against injury or death.Vehicle modifications of any kind (including software alterations) that facilitate high-performance driving may reduce or limit the life of your vehicle and any of its wearable parts and could result in damage to the vehicle. OSPREY PERFORMANCE LTD is not responsible for damage of this kind.Unless otherwise noted, certain products sold by OSPREY PERFORMANCE LTD are intended for off road and motorsport / racing use only and have not been tested or approved by any international, federal or local governing agency for street use. In addition, although every effort is made to have zero negative impact on emissions, these products may not be legal for sale or use on UNITED KINGDOMS pollution-controlled motor vehicles and are not intended or applicable for highway or road use. OSPREY PERFORMANCE LTD makes no claim of fitness or certification for such use.Understanding the inherent dangers to life and property (including your vehicle), and the legal requirements and limitations regarding the use of these products is the sole responsibility of the user. OSPREY PERFORMANCE LTD liability is limited to the original purchase price of the merchandise. It is important to remember that vehicle components can fail when standard just like when modified. This may show up weak points in your setup as you are now asking it to work harder than it is used to. You must look after the engine, regular servicing with good oil & parts, good quality fuel and mechanical sympathy all help keep your engine running well, if your car needs mechanical attention, get this work done before considering any modifications.We do not cover the liability or warranty of any mechanical or electrical parts including the following but not limited to: turbos, injectors, engines, gearboxes, boost leaks (boost pipes) as these have a serviceable lifespan and modifications may apply bigger demands on these parts, which may cause issues if they are not in good health. We do not accept any liability for the engine and parts to be within their expected tolerances should part failure occur after modification. If you want to have your vehicle checked over prior to modification then please book in for this service. This is an additional paid for service and isn’t included in any fitment / modification.A reminder that some products are sold for off-road / motorsport use only. Some modifications will almost invariably make your vehicle illegal for use on a public road. This is not legal advice and if you are unsure if this applies to your vehicle, please seek further advice.Some products and services are strictly sold as an off-road / motorsport use only and driving your vehicle on the road with these modifications could result in prosecution. It is your responsibility to declare your modification to the relevant authorities and insurances including vehicle manufacture warranties. Pops and Bang service is at solely customer own risk. Specifically, no warranty of merchantability, fitness for a particular purpose or any other warranty or insurance is made or to be implied with respect to modification and tuning of this level. The Client Must: - Accept that all power/torque gains are approximate as performance is lost over time and components perform differently depending on age and manufacturing issues.- Accept that the fuel efficiency of your vehicle after modifications including tuning depends on a number of factors including but not limited to: outside temperature, driving style, tyre pressures, mileage, the weight carried by the vehicle and regular and correct service maintenance of your vehicle. - Know that OSPREY PERFORMANCE LTD are not liable for costs associated to fix either present or pending faults found relating to your vehicle during its diagnostic check either before or after any modifications.- Accept it is your responsibility to inform your insurance company of any modifications. - Accept we will not test the car above the legal speed limit on public roads and therefore are unable to confirm any performance related times.- Know that remapping can void all warranties with the vehicle manufacturer.- Know that any emissions bypass control software such as DECAT, DPF, GPF, EGR delete is to only be used for off road and motorsport / racing use due to tax, environmental reasons and MOT regulations. By installing these Products and/or Services, you understand and agree that as a performance products and/or services, individual results may vary depending on make, model, age, engine health and usage.OSPREY PERFORMANCE LTD shall in no way be held responsible nor liable for any of the results, claimed or otherwise, that may or may not come from the product or service.You also agree that the original vehicle manufacturer makes its own determinations regarding the effects of Add-On products and/or service to its warranties, we shall in no way be held responsible nor liable for anything pertaining to or resulting from the original vehicle manufacturers warranty and/or terms of use.- As part of the test drive we aim to ensure that your car has responded well to any services provided / fitments and modifications and ensure that the new settings have not caused any faults with your vehicle. - We will not travel to your location for any issues - we require clients to bring the vehicle back to us should there be an issue after the work has been completed.- We won’t accept any liability for any additional costs or loss of earnings. Any costs relating to any issue after fitment / modification or installation should be enquired with us first so that we can be given the opportunity to fix any issues prior to any other persons or companies working on the vehicle. Failure to do this will result in us refusing to assist / replace or refund according to our returns policy. Some products are not sold for street use in any locality where regulations prohibit use.  Unless otherwise stated, OSPREY PERFORMANCE LTD does not make any claims for street legal use of these products.  Products sold for motorsport / racing use may never be used on a public highway or roads. Any situation arising from or liability occurring from the use of any item purchased from OSPREY PERFORMANCE LTD is solely the customer’s responsibility. OSPREY PERFORMANCE LTD has certain products may be covered by the manufacturer’s warranty. Any such warranty will be set forth in writing. Unless otherwise reflected in writing, products sold carry no express or implied warranty. Motorsport / Racing products are not covered by warranty due the excessive stress they get put under. A reminder is that it is the responsibility of the vehicle owner to ensure the vehicle has been maintained in accordance with the manufacturer’s recommendation including relevant cambelt changes / timing chain maintenance and that the vehicle is in FULL and TOTAL roadworthy condition.We carry out a brief visual inspection and diagnostic scan of your vehicle as part of the process. This will not provide a definite conclusion on the condition of mechanical components such as turbo, engine, gearbox etc. Therefore, no warranty is given or implied to any components on your vehicle before or after any tuning / mapping process. All of our engine and gearbox remaps are tested to the highest standards are used in accordance with the manufacturers requirements. However, engine parts that are subject to wear may be prone to failure after tuning. Common failures include but are not limited to turbo, injectors and sensors. These are all serviceable items that would usually require replacement as part of good maintenance. We do not accept liability for any mechanical part failure before, whilst and after performance tuning and we do not offer any type of warranty for your modified vehicle. Carrying out a remap on any vehicle without a thorough health check first is at your own risk. By purchasing online and accepting the Terms and Conditions – Disclaimer this release of liability, at date of purchase by the Customer with regard to OSPREY PERFORMANCE LTD their principals, partners, agents or assigns: hereinafter, Agent. 

 

Dynamometer Disclaimer: By purchasing fitment and having fitment done and accepting the Terms and Conditions – Disclaimer this release of liability at date of purchase and date of fitment by the Customer with regard to OSPREY PERFORMANCE LTD their principals, partners, agents or assigns: hereinafter, Agent It is understood that the Customer desires Agent to operate his vehicle for the purposes of fitment, testing, evaluation, or mechanical service whereby fitment, tuning, dyno services are required. Customer grants permission for Agent to operate his vehicle in any manner it deems appropriate, including operation on and off a dynamometer, and the Customer assumes full liability for loss or damage during said operation.Customer agrees that Agent is not responsible for any loss or damage to his vehicle or person as a result of the operation of same. Agent has made no representations other than those expressly made herein. No warranties or guarantees have been made to Customer who expressly acknowledges and understands the following:- Vehicles can and do suffer serious and catastrophic damage during or after operation on a Dynamometer. A Dynamometer pushes a vehicle and many of its mechanical components to critical levels which by its very nature may cause failure of those components.- Automobiles are inherently unpredictable and unsafe, and operating or riding in a vehicle can lead to serious injury or death.Customer agrees that all risk of loss or damage to his vehicle or person with regard to operation of his vehicle by Agent remains with him.CUSTOMER IS RESPONSIBLE FOR EVERYTHING INCLUDING ANY DETERMINATION OF ROAD WORTHINESS OR SAFETY OF HIS VEHICLE AFTER OPERATION BY AGENT, AND EXPRESSLY ACKNOWLEDGES THAT AGENT IS NOT RESPONSIBLE FOR ANY LOSS OR DAMAGE TO HIS VEHICLE OR PERSON AS A RESULT OR THIS OPERATION AND HEREBY RELEASES, DISCHARAGES, AND INDEMNIFIES AGENT FOR ANY AND ALL CAUSES OF ACTION ARISING AS A RESULT OF THE OPERATION OF HIS VEHICLE BY AGENT. Customers have read the terms and conditions in its entirety and understand the terms and conditions contained herein. This release is continuing in nature and shall apply to this and any other vehicle I own or have control over which modifications are purchased. If I desire to terminate this release and no longer require or have these modifications, I will do so in writing and will deliver said termination to Agent via Certified Mail, return receipt requested.

 

When visiting our premises: Users of the car park and premises do so at their own risk. Management and OSPREY PERFORMANCE LTD will accept no liability for damage, accident or loss. We will accept no liability for injury or death whilst on these premises. Enter at your own risk. Do not enter unauthorized areas. We ask that you please reduce your speed when entering and leaving our premises.
